Terms of Service

These Terms of Service ("Terms") govern your access to and use of ListPilot (the "Service"), a software platform that helps you create and manage eBay listings from a connected product source, price them, and record order fulfillment. By creating an account or using the Service, you agree to these Terms.
1. What ListPilot is (and is not)
ListPilot is independent software. We are not eBay, Amazon, or any marketplace, supplier, carrier, or payment network, and we are not affiliated with or endorsed by any of them. We do not buy, hold, source, or ship inventory, and we are not a party to any sale between you and a buyer or between you and a supplier. You are the merchant of record for every listing and order.
2. Your responsibilities
- You must have the legal right to sell and fulfill every product you list, including any required authorization from the brand or supplier.
- You are solely responsible for complying with the policies and terms of every marketplace and supplier you connect, including eBay's seller and dropshipping policies and any supplier's terms. See our Acceptable Use Policy.
- You are responsible for fulfilling orders accurately and on time, for providing genuine carrier tracking, for customer service, taxes, and for the accuracy of your listings.
- You must keep your account credentials secure and are responsible for activity under your account.
3. Accounts and eligibility
You must be at least 18 and able to form a binding contract. You agree to provide accurate information and to keep it current.
4. Subscriptions, trials, and billing
Paid plans are billed in advance on a recurring basis through our payment processor. If you start a free trial and provide a payment method, you authorize us to charge the applicable plan fee when the trial ends unless you cancel before then. Plan limits (such as listings per month) apply as described at sign-up. See our Refund Policy.
5. Connected accounts and authorizations
When you connect eBay, a supplier, or another third-party account, you authorize ListPilot to access and act on that account on your behalf solely to provide the Service (for example, to create listings or submit tracking). You may disconnect at any time. Your use of those third-party services is governed by their terms, not ours.
6. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. Violation may result in suspension or termination.
7. Intellectual property
The Service, including its software and content, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your data and content.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will result in any particular sales, profit, or account outcome on any marketplace.
9. Limitation of liability
To the maximum extent permitted by law, ListPilot will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sales, or marketplace account suspension, loss, or penalty. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the three months before the claim.
10. Indemnification
You agree to indemnify and hold ListPilot harmless from claims arising out of your listings, your products, your fulfillment, your use of connected accounts, or your violation of these Terms or any marketplace or supplier policy.
11. Termination
You may cancel at any time. We may suspend or terminate access for violation of these Terms or the Acceptable Use Policy, or as required by law. Sections that by their nature should survive termination will survive.
12. Changes
We may update these Terms. If we make material changes, we will provide notice. Continued use after changes take effect constitutes acceptance.
